Understanding Tax Mitigation Alternatives that are Green, Sustainable & Socially Responsible.  As tax rates continue to rise for the wealthiest Americans, renewed focus has been placed on tax mitigation strategies that generate significant tax credits and tax deductions.  A growing current trend involves combining SRI with tax mitigation.  We will explore the use of private equity investments into land conservation, historic building preservation, renewable energy and film documentaries as a way to produce multilayered tax and non-tax ROIs for family offices.

 

Ricky B. Novak serves as a Managing Partner of the Strategic Group of Companies, an Atlanta based firm built on a platform of delivering tax efficiency through global business solutions and private equity capital. As part of his role with SGC, Mr. Novak serves as CEO of SGC affiliate Strategic 1031 Exchange Advisors (“SEA”). SEA is a boutique advisory firm and qualified intermediary that provides real estate and tax consulting services for clients structuring complex real estate transactions and asset dispositions. SEA’s global client base includes many of the most sophisticated commercial and residential real estate investors and developers. Mr. Novak specializes in the facilitation of tax-deferred like-kind exchanges under Internal Revenue Code Section 1031, and has assisted clients in structuring reverse exchanges, construction exchanges, non-safe harbor exchanges, personal property exchanges, multi-asset business sales, and international exchanges. Further, Mr. Novak also serves as Co-Managing Partner of SGC affiliate Strategic Capital Partners (“SCP”), a boutique investment bank focused on “Green, Sustainable and Socially Responsible” tax strategies, often involving federal and state tax credits and benefits. Mr. Novak’s expertise includes assisting clients in both the creation and syndication of conservation easement, historic preservation, renewable energy and entertainment tax benefits. SGC also serves within the family office organizational structure for several domestic and international families. Mr. Novak has spoken locally and nationally on various real estate related topics, and has served as a guest lecturer for numerous universities and law schools. Additionally, his writings have been published in a varying array of periodicals, including Commercial Investment Real Estate (the magazine of the CCIM Institute), Shopping Center Business, and the Scotsman Guide. Mr. Novak was honored by his legal peers by his selection as a 2009 Georgia SuperLawyer® Rising Star, an honor bestowed upon only the top 2.5% of attorney’s under 40 years old. His peers also selected him as one of Georgia Trend Magazine’s 2009 & 2010 Legal Elite. Additionally, Mr. Novak was the recipient of both the Atlanta Bar Association’s 2010 Distinguished Service Award and the Atlanta Bar Association Real Estate Section’s 2012 Member of Distinction Award. Mr. Novak obtained his undergraduate degree from the Georgia Institute of Technology, graduating magna cum laude, majoring in International Affairs with Certificates in International Business Management and Spanish. He is credited with studying at both the European Union and NATO in Brussels, Belgium. Mr. Novak received his Juris Doctorate from Emory University’s School of Law, with a concentration in tax, real estate, and international law. He also attended the Jagiellonian University School of Law in Krakow, Poland, concentrating in Eastern and Central European business and law. Finally, Mr. Novak attended the Yale University School of Management’s Center for Business and the Environment, with a focus in conservation finance. Mr. Novak joined Arthur Andersen’s Global Tax practice, where he assisted multinational clients with global tax strategy, corporate restructuring, and mergers & acquisitions. He later joined Deloitte & Touche’s Atlanta Real Estate Tax practice, where he furthered his tax expertise by structuring complex real estate transactions for major national and international real estate investors, REITs, partnerships, and corporations. Mr. Novak currently lives in the metro Atlanta area with his wife, Lisa, and their son, Aidan. He is an active member of the State Bar of Georgia and the Buckhead Club. Mr. Novak previously served on the Board of Directors for the Atlanta Bar Association for several years, and currently serves on the Atlanta Bar Association’s Real Estate Section Board and the Real Estate Group of Atlanta’s Board. He is a member of various community and volunteer organizations and is an active members of his church.
